Terms and conditions
The tenancy agreement:
The temporary rental agreement for the rental property is concluded between you as the tenant and Bessis Immobilien Mourad Bessis. The object of the contract is the temporary transfer of use of a rental property for residential purposes.
1. the tenant may withdraw from the rental agreement at any time or provide a replacement tenant. The declaration of cancellation or replacement tenant is effective from the day on which it is received by the landlord (host sounds like an invitation, i.e. free of charge). To avoid later discrepancies, the written form (letter, fax, e-mail) is strongly recommended! Cancellation up to 12 weeks before the start of the rental period will not incur any costs for the tenant. If an advance rental payment has already been made, this amount will be refunded. For a cancellation after 11 weeks before the start of the rental period, the host can request reasonable compensation for the landlord in accordance with § 651 j BGB.
The compensation claim amounts to:
a.) for cancellations from 12 to 08 weeks before the start of the rental period: 20% of the rental price
b) Cancellation from 08 to 04 weeks before the start of the rental period: 50% of the rental price
c) Cancellation from 04 to 02 weeks before the start of the rental period: 80% of the rental price
d) in the event of cancellation from 02 weeks before the start of the rental period or in the event of non-arrival: 100% of the rental price. .
Complaints must be reported by the tenant to the landlord immediately or within 24 hours at the latest. The landlord shall endeavour to rectify the defects within a reasonable period of time.
The tenant undertakes to protect the rented premises and inventory from damage and to return them at the end of the rental period with all keys and accessories according to the inventory. Damaged or unusable items must be replaced in such a way that the landlord suffers no disadvantage as a result.
Furthermore, the tenant undertakes not to do anything detrimental to the rented property and the fixtures and fittings, nor to report to the landlord without delay anything that appears to be defective or harmful in any way, and not to sublet the rented property in whole or in part, i.e. the property may only be occupied by those persons mentioned below.
Legal effect of electronic media; the management reserves the right not to recognise claims arising from the misuse of the homepage, e-mail data and e-mail addresses.
Damage to the house or inventory caused by the tenant is to be borne by the tenant. Missing items according to the inventory list must be reimbursed at the tenant's expense. No obstructing objects may be thrown into the toilets and drains.
Smoking is not permitted in the flat. The stove may not be used as it is a decorative item. Pets are not permitted in the flat or require the explicit written consent of the landlord. This may result in a negotiable tenancy. Telephone and other expenses will be charged at the end of the tenancy.
The place of jurisdiction for disputes arising from this contract shall be the location of the rental property. German law shall apply.
